Diana FitzgeraldDiana L. Fitzgerald is a member of the Florida, California, New York and District of Columbia Bars. She is a senior partner and founder of the Firm.

Throughout Ms. Fitzgerald's 25 years plus of practice, she has served as counsel for several Fortune 500 companies, privately-held companies, start-ups, investors, entrepreneurs, and business professionals. She also serves as general counsel for various companies in the entertainment, manufacturing and service industries as well as non-profits such as Zoo Miami Foundation.

Ms. Fitzgerald's practice features complex business litigation in federal and state courts involving a wide variety of business torts, employment claims, and contract disputes inclusive of insurance matters, as well as transactions relating to commercial closings, and corporate agreements such as partnerships, limited liability companies, and limited partnerships.

Ms. Fitzgerald's experience includes unfair competition claims involving fraud and unfair deceptive trade practices, non-compete agreements, trade secrets, and defamation. She is knowledgeable in all aspects of employment law (sexual harassment, discrimination, and whistleblower) having represented both employers and employees. Ms. Fitzgerald also has significant experience in insurance premium financing as well as coverage counseling and "bad faith" litigation under Business Comprehensive General Liability (CGL) policies, Director's & Officer's insurance policies, and Fidelity Bonds. She also counsels real estate clients, including hotel owners, multi-family dwelling owners, developers, condominium associations as well as private lenders in commercial foreclosure, and litigation, and real estate transaction closings where she also acts as a title agent.

During the dot.com frenzy, Ms. Fitzgerald served as Principal, General Counsel and Executive Vice President of an entertainment conglomerate, which included an Internet portal of celebrated personalities ranging from Charlie Sheen to Albert Einstein, a toy company, and an entertainment replica company (licensors included Universal Studios and Canal + D.A.). She was responsible for enforcing intellectual property rights, negotiating and drafting licensing agreements, managing more than 50 employees and creating and monitoring corporate policies/procedures.

Ms. Fitzgerald is admitted to practice in all Florida, California, and New York state courts as well as the District of Columbia Superior Courts and the Court of Appeals, the United States District Court for the Central and Southern Districts of California, the United States District Court for the Middle and Southern Districts of Florida, the United States District Court for the Eastern District of Louisiana, the United States District Court for the District of Colorado, and the Fifth, Ninth, and Eleventh Circuit Courts of Appeals.

Ms. Fitzgerald is a graduate of the State University of New York at Binghamton (B.S. Finance) and Southwestern University School of Law in Los Angeles, California (J.D.). In law school, she was a member of the Moot Court Honors Program, and the Western Regional Winner for the Jessup International Law Moot Court Competition. She was also a judicial intern for the Court of Appeal of the State of California, Second Appellate District, Div. Five, Hon. M. Grignon.

Ms. Fitzgerald's community work includes serving on the Board of Directors for the Zoo Miami Foundation, and as the chairperson for the legal committee. For 10 years, Ms. Fitzgerald served on the executive committee board for Special Olympics of Miami-Dade, Florida. She was the event co-chair for the Annual Fall Fashion show presented by Saks Fifth Avenue as well as the co-chair for the Annual Inspiration 5k Run benefiting Special Olympics. She was also a mentor with Volunteers In Parole, a non-profit program assisting parolees from the California Youth Authority, and has also been actively involved with various other non-profit organizations.
